Can You Expedite an I-130 Petition?

Waiting for an I-130 petition to be approved can be one of the most difficult parts of the spouse visa process. Long processing times can keep couples separated and make it difficult to plan their future together.

The waiting can become even more stressful when one spouse is dealing with a serious health problem, family emergency, or another urgent situation.

Many couples facing these circumstances ask the same question: Can an I-130 petition be expedited?

The answer is yes, it may be possible to request faster processing. However, USCIS expedite requests are difficult to get approved. Couples should understand what an expedite request is, what circumstances USCIS may consider, and what evidence may be needed before submitting one.

 

 

What Is a USCIS Expedite Request?

An expedite request is a request asking USCIS to decide an immigration petition or application faster than it normally would.

When USCIS approves an expedite request, the agency may move the case forward ahead of other cases that have been waiting in the regular processing line.

This is why expedite requests are generally reserved for unusual and urgent circumstances. USCIS understands that long immigration processing times are difficult for many families. A long wait by itself, however, will not always be enough to receive expedited processing.

The couple must normally explain why their situation requires USCIS to take action sooner.

Can an I-130 Petition Be Expedited?

A pending I-130 petition may be considered for expedited processing.

Form I-130, Petition for Alien Relative, is commonly filed by a U.S. citizen or lawful permanent resident who is sponsoring a spouse or other qualifying family member. For couples completing the spouse visa process, approval of the I-130 is an important early step.

Some I-130 petitions can remain pending for well over a year. Unfortunately, experiencing a normal processing delay does not automatically qualify a case for expedited review.

The couple must show that there is an additional emergency, humanitarian concern, or other compelling reason that makes their circumstances different from the normal hardship caused by waiting.

The process for requesting expedited treatment also depends on where the case is pending. A request involving a petition at USCIS may be handled differently from a case that has already moved to the National Visa Center or a U.S. embassy.

Understanding the current stage of the case is therefore an important first step.

What Circumstances May Support an Expedite Request?

USCIS identifies several general circumstances it may consider when reviewing an expedite request. These can include severe financial loss, emergencies or urgent humanitarian situations, certain nonprofit interests, government interests, or a clear USCIS error.

These categories do not mean that every request involving one of these issues will be approved. USCIS reviews each request based on the specific facts and supporting evidence.

The question is not only whether a couple is experiencing hardship. The couple must explain why the hardship is urgent enough to justify moving the case ahead of other pending applications.

This is a high standard because many couples are experiencing long waits, separation, financial pressure, and emotional distress.

Can a Health Issue Support an Expedite Request?

A serious health issue can potentially support an expedite request.

For example, the U.S. citizen petitioner may have a medical condition and need the immigrant spouse in the United States to provide care and support. In another case, the immigrant beneficiary may need to enter the United States to receive medical treatment.

The existence of a medical condition alone may not be enough. USCIS will want to understand the seriousness of the condition, why the situation is urgent, and how faster processing of the immigration case would help address the problem.

Important questions may include:

What is the medical condition?

How serious or time sensitive is it?

Is the person able to care for themselves?

Why is the spouse’s physical presence needed?

Are other caregivers or treatment options available?

What may happen if the case continues through normal processing?

The answers to these questions can help determine whether the circumstances may support an expedite request.

Why Are Expedite Requests Difficult to Get Approved?

USCIS treats expedited processing as an exceptional measure.

Approving one request may mean reviewing that case before other petitions filed by families who have also been waiting for a decision. Because of this, USCIS generally expects a compelling explanation supported by strong evidence.

An expedite request is not simply a request to avoid an inconvenient delay. It must show why the particular case requires faster attention.

Even a request involving a serious and sympathetic situation may be denied. USCIS has discretion when deciding whether the circumstances justify expedited processing.

Couples should therefore approach the process with realistic expectations. Filing an expedite request does not guarantee that USCIS will approve the request or decide the underlying petition immediately.

What Evidence Can Strengthen an Expedite Request?

The evidence will depend on the reason for the request.

For a health-related expedite request, useful documents may include medical records, letters from doctors, treatment plans, hospital records, and information explaining the patient’s care needs.

The evidence should do more than confirm that a medical condition exists. It should help USCIS understand why the situation is urgent and why faster processing of the immigration case would make a meaningful difference.

A strong request may also include a detailed written explanation connecting the evidence to the requested immigration action.

For example, a doctor’s letter may explain that the petitioner has a serious condition. The expedite request should then explain why the immigrant spouse is needed, what care the spouse would provide, and why other available support is not sufficient.

USCIS should be able to understand the complete situation without having to make assumptions.

How Do You Request an Expedite?

The correct process depends on where the immigration case is currently pending.

Before making the request, couples should confirm which government agency has the case and gather the receipt number, filing notices, medical documents, and other supporting records.

The initial request may be relatively brief. USCIS may then ask the couple to provide documents supporting the claimed emergency or urgent circumstances.

Couples should be prepared to respond with clear, organized, and persuasive evidence.

Because approvals are difficult to receive, the request should be treated seriously from the beginning. A rushed request with limited documentation may fail to clearly explain why the case deserves expedited treatment.

What Is the Likelihood of Approval?

There is no reliable way to promise that an expedite request will be approved.

USCIS considers each request individually, and the outcome depends on the urgency of the circumstances, the quality of the evidence, and how clearly the request explains the need for faster processing.
