I-134 Form
The I-134 form, often referred to as the “lite” affidavit of support, is used primarily in the fiancé visa (K-1 visa) application process. It is designed to demonstrate that the immigrant fiancé will have sufficient financial support in the United States and will not rely on public benefits. This form must be completed and submitted by the US petitioner during the immigrant fiancé’s interview abroad to facilitate the issuance of the K-1 visa.
I-864 Form
Post-marriage, when a couple moves forward with adjusting the immigrant spouse’s status to become a permanent resident, the I-864 form comes into play. Known as the full affidavit of support, this form is more comprehensive and serves as a binding legal contract between the sponsor (usually the US citizen spouse) and the US government. The I-864 ensures that the immigrant has adequate financial backing to avoid becoming a public charge.
Differences and Significance
Understanding the distinctions between the I-134 and I-864 forms is essential for couples going through the US immigration system. Ensuring that these forms are accurately completed and submitted with the correct supporting documents is important to the success of your visa and green card applications.
