Choosing Between a Fiancé Visa and a Spouse Visa

The Fiancé Visa (K-1)

The K-1 visa, commonly known as the fiancé visa, is designed to bring your fiancé to the United States for marriage. This visa requires that you marry within 90 days of entry, after which you must file for an adjustment of status to secure a green card. Although the processing time for a fiancé visa is generally shorter—about 12 months—it may not be the best option for everyone.

While the fiancé visa allows for a quicker reunion, it does come with limitations. The most significant is that the visa holder cannot work or travel outside the U.S. until they receive their work and travel permits. This period can be challenging as it limits your ability to start working immediately or visit home if needed.

The Spouse Visa (CR-1)

On the other hand, the spouse visa, or CR-1, takes longer to process—approximately 18 months. However, it allows the immigrant spouse to enter the U.S. as a permanent resident. This status enables them to work and travel internationally without waiting for additional documentation.

For many couples, the spouse visa is preferable despite the longer waiting time. Entering the U.S. with a green card means that the immigrant spouse can immediately start working, travel as needed, and settle into their new life without the interim restrictions imposed by the fiancé visa.
