The U.S. Citizenship and Immigration Services (USCIS) has introduced a significant update to the medical exam requirement for green card applicants, simplifying the process and alleviating some of the stress for applicants. The medical exam is an important part of the marriage adjustment of status process, where the immigrant beneficiary must undergo a health examination by a USCIS-approved civil surgeon. The results are then submitted to USCIS to ensure the applicant does not have any medical conditions that would make them inadmissible to the United States.
Recent Changes to the Validity Period
Historically, the validity of these medical exams was limited to one year, and then extended to two years. However, in a welcome change effective from November 2023, these medical exams now have indefinite validity for exams conducted on or after November 1, 2023. This means that unless specifically requested by an immigration officer, applicants no longer need to worry about their medical exam expiring before their application is processed.
This update significantly reduces the burden on applicants, who previously had to manage the timing of their medical exams closely with their application submission to avoid the need for re-examination due to expiry. Now, applicants can feel more at ease knowing their medical results will remain valid indefinitely, streamlining the adjustment of status process.
Exceptions and Officer Discretion
This update is a positive development in making the green card application process more applicant-friendly. By removing the expiration on medical exams, USCIS is helping to streamline the process and reduce the logistical burdens on applicants. But while this change offers relief, it’s important to note that USCIS officers retain the discretion to request an updated medical exam if there are concerns about a disqualifying medical condition or other significant health changes since the initial exam.
